現代建設項目爭端、仲裁、索賠、訴訟法律風險防范實務研討會

各有關單位:

隨著我國經濟不斷發展,建筑行業的市場競爭也不斷加劇,而建設施工企業經營過程中,各環節所涉及的法律風險問題也日益增多。“索賠”這個詞已越來越為人們所熟悉,并日益成為企業關注的一個焦點問題。索賠工作的正常開展,有利于落實合同雙方權益,同時也是雙方用科學的方法和法律手段爭取自己利益的途徑。因此了解和掌握索賠工作的內容應注意的問題,及如何科學運用有效的方法開展索賠事宜顯得尤為重要,應有關單位要求,中國建筑培訓網決定召開 “現代建設項目爭端、仲裁、索賠、訴訟法律風險防范實務研討會”。

本次會議將邀請國內權威法律工作者及最高人民法院相關領導參與交流研討,請各相關單位領導選派代表參與詳細內容如下:

一、會議內容:

1、建設工程項目風險防范典型案例與實務

重點關注:建筑企業如何有效防范金融危機帶來的影響

1) 招標投標中存在的法律風險、易引起爭議和糾紛點及規避與防范的措施;

2) 建設工程合同的法律風險規避與合同糾紛處理技巧;

3) 企業內部承包,分包、掛靠、轉包存在的法律風險及規避和應對措施;

4) 建設工程質量控制中的法律風險與防范;

5) 建設項目進度控制及工程竣工驗收階段的法律風險與防范;

6) 應用保險和擔保控制建設工程項目風險;

7) 使項目管理者始終處于法律有利地位證據的收集,制造、保管和固定技巧;

8) 司法解釋對解決拖欠工程款的新規定以及對合同管理提出的新要求。

3、建設工程合同管理及索賠

重點關注:已簽訂的建設工程施工合同中對索賠的約定

1) 建設工程施工合同示范文本的索賠規定及合同版本解讀;

2) 在工程項目施工全過程中預測、尋找和發現索賠機會;

3) 不可抗力的界定與非人為造成質量變化引發的索賠;

4) 建設工程合同糾紛中對工程價款的確定;

5) 建設工程索賠常見的幾種解決方式;

6) 施工索賠的法律理論和法律依據, 建設工程索賠案例;

7) FIDIC合同條件與《建設工程施工合同(示范文本)》差異

8) 施工單位加強合約管理的主要環節;

各省、市、建設監管部門,各勘察設計、工程監理、工程咨詢、施工建設企業,房地產開發經營企業,項目業主,工程承包企業及城市投資集團公司,各律師事務所、房地產專業律師。
